When you take an issue to court there are a number of court fees.

If you have a lawyer they might pay these upfront and then add them to your bill.

If you don’t have a lawyer you will need to pay the fees directly to the Court.

Sometimes a lawyer might need you to pay a portion of the expected total cost upfront. They can use this money to pay for some expenses related to your case. 

In some cases it is possible to waive the court fees. For example, the Federal Court will waive the court fees of a health care card holder and the Magistrates and County Courts will waive the fees of a person who can provide an affidavit demonstrating their financial incapacity to pay fees. 

Each Court has different fees, check with the court to make sure you have a good expectation of how much the court fees will be.
